1. Who we are and what these terms cover

Mutan Unlimited (MutanUnlimited.com) is the trading name of CV Mutan Nusantara, Mataram, Nusa Tenggara Barat, Indonesia ("we", "us", "the Operator"). We run small-group sea kayaking day trips and multi-day expeditions in Sekotong Bay and the south-west Gili islands of Lombok ("Trips").

These terms apply to every booking made with us, whether through this website, by email, by WhatsApp or in person. By paying a deposit you ("the Guest", "you") confirm that you have read and accepted these terms on behalf of yourself and everyone included in your booking, and that you are at least 18 years old or booking with the consent of a parent or guardian.

2. Bookings and quotations

(a) A booking request is not confirmed until we have sent you written confirmation and received your deposit.

(b) Prices are quoted, invoiced and paid in Indonesian rupiah (IDR). Any other currency shown on the website is indicative only and is calculated at the exchange rate current at the time of quotation.

(c) Quotations are valid for [14] days. The price confirmed in your booking confirmation is fixed unless you change the booking.

(d) Unless the confirmation says otherwise, the price includes guide, kayak and paddling equipment, safety equipment, meals and accommodation as described in the Trip itinerary, and boat support where listed. It excludes flights, transfers to and from the meeting point unless listed, travel insurance, personal expenses, tips and anything described as optional.

3. Deposit and payment

(a) A deposit of [30%] of the Trip price is payable to confirm a booking.

(b) The balance is due [30] days before the Trip start date. For bookings made within [30] days of departure, the full price is payable at the time of booking.

(c) Payment is by bank transfer to the account shown on the invoice. Bank fees and currency conversion charges are the Guest's responsibility. Please send a remittance advice or screenshot so we can match your payment.

(d) If the balance is not received by the due date we may treat the booking as cancelled by you under clause 4 and release your place.

4. Cancellation by the Guest

(a) Cancellations must be made in writing (email to [email protected]). The cancellation date is the day we receive your message.

(b) The following charges apply, calculated as a percentage of the total Trip price:

   More than [60] days before departure: loss of deposit.

   [60] to [31] days before departure: [50%] of the Trip price.

   [30] days or fewer before departure, or no-show: [100%] of the Trip price.

(c) Where you cancel more than [60] days out, we will offer to transfer your deposit to another Trip departing within [12] months instead of forfeiting it, subject to availability.

(d) If one member of a group cancels, the remaining Guests may be re-quoted where the group price depended on numbers.

(e) No refund is given for any unused part of a Trip once it has started, including if you leave early by choice, illness or injury. This is what travel insurance is for — see clause 10.

5. Changes by the Guest

We will try to accommodate requests to change dates or itinerary. Changes made [more than 30] days before departure are free where we can accommodate them; later changes are treated as a cancellation and rebooking under clause 4, unless we agree otherwise.

6. Cancellation or changes by us

(a) Minimum numbers. Some Trips need a minimum of [2] Guests. If minimum numbers are not reached [14] days before departure we may cancel the Trip and will offer you an alternative date or a full refund of everything you have paid to us.

(b) Weather, sea and safety conditions. Sea kayaking depends on the weather. The guide's decision on whether it is safe to paddle is final. If we cancel or shorten a Trip because of weather, sea state, tides, an official warning, a natural event or any other safety reason, we will first try to reschedule, change the route or substitute an equivalent activity. Where that is not possible we will refund the cost of the unused days, less any non-recoverable costs already paid to third parties (for example boat charter or accommodation). We are not responsible for any other costs you incur, such as flights, extra nights of accommodation or transfers.

(c) Other reasons. If we have to cancel for a reason within our control (for example guide illness with no replacement available) we will offer an alternative date or a full refund of everything you have paid to us. That refund is the limit of our liability for the cancellation.

(d) Itineraries are a guide, not a guarantee. Islands visited, campsites, distances and timings may change on the day at the guide's discretion.

7. Fitness, health and experience

(a) Sea kayaking is a physical activity. You confirm that you and everyone in your booking are in good health, able to swim at least [50] metres in open water, and physically able to paddle for the durations described in the Trip itinerary. No previous kayaking experience is needed for Trips described as suitable for beginners.

(b) You must tell us in writing before booking about any medical condition, injury, pregnancy, allergy, dietary requirement, medication or reduced mobility that could affect your safety or participation. We may decline a booking, or ask for a doctor's clearance, if we do not think a Trip is suitable. We will keep this information confidential and use it only to plan and run your Trip safely.

(c) You are responsible for bringing any personal medication you need and for telling your guide where it is kept.

(d) Minimum age is [12] years, and Guests under 18 must be accompanied by a parent or guardian who accepts these terms on their behalf.

8. Your responsibilities during the Trip

(a) You must follow the reasonable instructions of the guide at all times, including wearing the buoyancy aid provided whenever you are on the water, staying with the group, and not paddling, swimming or snorkelling outside the areas the guide has indicated.

(b) You must not participate while affected by alcohol or drugs.

(c) We may remove any Guest whose behaviour, in the guide's reasonable opinion, endangers themselves, other Guests, the crew or the environment. No refund is payable and any costs of returning that Guest to the meeting point are theirs.

(d) You are responsible for equipment issued to you and for loss or damage to it caused by negligence or misuse, at replacement cost. Fair wear and tear is not charged.

(e) You must respect local communities, marine life and protected areas: no touching or standing on coral, no collecting shells or wildlife, no littering, and no drones without prior permission from us.

9. Assumption of risk, waiver and release

(a) You acknowledge that sea kayaking, snorkelling, camping and boat travel carry inherent risks that cannot be eliminated even with proper care and supervision. These include, but are not limited to, capsize, drowning, exposure to sun and heat, dehydration, marine stings and bites, injury from rocks and coral, strong currents and changing weather, remoteness from medical facilities, and the delayed availability of rescue or evacuation.

(b) You confirm that you have read the Trip description, understand these risks, and voluntarily accept them for yourself and any minors in your care.

(c) To the fullest extent permitted by Indonesian law, you release CV Mutan Nusantara, its owners, guides, crew and contractors from liability for any injury, illness, death, loss or damage to property arising from your participation in a Trip, except where it is caused by our gross negligence or wilful misconduct.

(d) Each Guest will be asked to sign a participation form containing this acknowledgment before the Trip starts. Refusal to sign will be treated as a cancellation under clause 4.

10. Travel insurance

Comprehensive travel insurance is a condition of booking. Your policy must cover medical treatment and emergency evacuation (including from remote islands and by boat or helicopter), cancellation and curtailment, and must specifically include sea kayaking. We may ask to see proof of cover. If you travel without adequate insurance, any costs of medical treatment, evacuation or repatriation are yours.

11. Limitation of liability

(a) We will run each Trip with reasonable skill and care using qualified guides and properly maintained equipment.

(b) Subject to clause 9, our total liability to you in connection with any booking is limited to the amount you paid us for that booking.

(c) We are not liable for indirect or consequential loss, including missed flights or onward travel, loss of enjoyment, or costs arising from events outside our reasonable control (including weather, sea conditions, natural disasters, epidemics, government action, strikes, or failures of transport, fuel or communications).

(d) Where a third party such as a boat operator, hotel or transport provider supplies part of your Trip, we act only as a booking agent for that part, and that provider's own terms apply.

12. Photographs and personal information

(a) Our guides may take photographs and video during the Trip. We may use these on our website and social media unless you tell us in writing, before or during the Trip, that you do not wish to appear.

(b) We collect your name, contact details, passport or ID details where required by local authorities, and the health information described in clause 7. We use it only to run your Trip, to comply with Indonesian law, and to contact you about your booking. We do not sell your information.

13. Governing law and disputes

These terms and any dispute arising from a booking are governed by the laws of the Republic of Indonesia. The parties will first try to resolve any dispute in good faith by discussion. If that fails, the dispute will be submitted to the District Court of Mataram (Pengadilan Negeri Mataram), whose jurisdiction the parties accept. If any provision of these terms is found unenforceable, the rest continue to apply.
